Acceptance of Terms

By accessing or using AlertGauge ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Nature of the Service

AlertGauge is a supplemental weather intelligence tool that processes publicly available data from the National Weather Service (NWS), NOAA ACIS, and other federal agencies. Our analysis models interpret this data to surface decision-relevant patterns such as flash freeze risk, livestock cold stress indicators, and power outage probability.

AlertGauge is not a weather forecasting service, emergency alert system, or substitute for official National Weather Service watches, warnings, and advisories. The Service is provided for informational and educational purposes only.

Weather Data Disclaimer

All weather data originates from the National Weather Service and other federal sources. AlertGauge does not independently observe, measure, or verify weather conditions. Our analysis models apply algorithmic interpretation to NWS forecast data, which introduces additional sources of potential error beyond the underlying forecast accuracy.

  • NWS forecasts may contain errors or may not reflect rapidly changing local conditions
  • AlertGauge analysis models use simplified approximations (e.g., Stull wet-bulb temperature estimation) that have documented accuracy limitations
  • Climatological baselines used for "unusualness" scoring rely on ACIS PRISM data, which may be temporarily unavailable or contain regional gaps
  • Alert thresholds are general-purpose and may not reflect the specific vulnerabilities of your property, livestock, or operations

Limitation of Liability

To the maximum extent permitted by applicable law, AlertGauge, its operators, and DeJarnett Consulting shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Reliance on weather intelligence, forecasts, alerts, or risk assessments provided by the Service
  • Failure of the Service to detect, predict, or alert on any weather event, including but not limited to flash freezes, ice storms, power outages, or livestock cold stress events
  • Actions taken or not taken based on information provided by the Service
  • Service interruptions, data inaccuracies, or delays in data delivery
  • Loss of livestock, crops, property, revenue, or any other damages resulting from weather events, whether or not the Service provided relevant alerts

You acknowledge that weather prediction is inherently uncertain and that no automated system can guarantee accurate detection of all hazardous weather conditions. You assume full responsibility for all decisions made using information from this Service.

Your Responsibilities

  • Monitor official sources. Always check NWS watches, warnings, and advisories at weather.gov for official weather information
  • Use professional judgment. AlertGauge supplements but does not replace your own assessment of weather risks and appropriate protective actions
  • Maintain backup plans. Do not rely solely on AlertGauge for critical safety decisions regarding livestock, property, or personal safety
  • Verify critical information. When AlertGauge indicates elevated risk, independently confirm conditions before taking costly protective measures

Indemnification

You agree to indemnify and hold harmless AlertGauge, its operators, and DeJarnett Consulting from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or your violation of these Terms.

Service Availability

AlertGauge is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access to the Service. The Service depends on third-party data sources (NWS, NOAA ACIS) that may experience outages beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
